TERMS OF SERVICE

This is a structured draft, not legal advice tailored to your situation. If you have specific concerns, email hello@webgecko.au.
Agreement
These terms govern your use of WorkPost, operated by WebGecko (ABN 32 300 992 377), Queensland, Australia. By creating an account or using the app, you agree to them. You must be 16 or older to use WorkPost.
Your account
You're responsible for the accuracy of the information you provide and for keeping your account credentials secure. Let us know immediately if you suspect unauthorised access to your account.
Your content stays yours
You own the photos, videos, voice recordings, captions and business records you create in WorkPost. By using the app, you grant WorkPost a licence to store, process and transmit your content solely to provide the app's features to you, including generating captions, baking music into your videos, converting formats for posting, and publishing to the social accounts you connect, on your instruction. This licence doesn't give us any ownership over your content, and it ends when you delete the content or your account.
Acceptable use
Use the app for its intended purpose: running and promoting your trade business. Don't upload or post unlawful, infringing, deceptive or harmful content, attempt to abuse or overload our systems, or use the app to spam or mislead others. Content you publish to Instagram or Facebook must also comply with those platforms' own rules, we're not responsible for their enforcement decisions.
AI-generated captions
Captions generated by our AI are suggestions, not final copy. You review and can edit every caption before it's posted. You're responsible for what ultimately gets published to your accounts.
Posting on your behalf
When you connect a social account and approve a post, you authorise WorkPost to publish that content to your account via the platform's API, acting on your instruction. We only post what you've approved. You're responsible for what you publish, including that you have the rights to any content involved and that it complies with the platform's rules.
Bundled music
WorkPost includes a set of bundled background tracks you can bake into your slideshow videos at no extra cost. These tracks are CC0 (public domain), see assets/music/CREDITS.md for sources, so you're free to use them in your published content without attribution or additional licensing.
Texting your customers
The review-request and invoice-payment texting features send a message to a client on your books only when you press send, never automatically. By using them, you warrant that you already hold whatever consent is needed to contact that person about their job with you, and that the phone number you've stored for them is correct and belongs to them. You're responsible for who you choose to message. We check every review-request number against your suppression list before sending and honour opt-outs, but the underlying decision to text someone is yours.
Asking for reviews
If you use the review-request feature, every customer whose job you mark complete gets offered the same message, we don't let you filter by rating or sentiment, and we never will. This isn't a limitation you can ask us to lift: Google's own review-solicitation policy prohibits asking only satisfied customers for reviews, and doing so risks Google removing your reviews or restricting your listing. We also don't offer, and won't build, any feature that pays or discounts a customer for leaving a review, that breaches Google's policy and Australian Consumer Law's rules on manipulated reviews.
Managing your Google Business Profile
If you connect your Google Business Profile, you authorise WorkPost to post to it on your instruction. We'll notify you in the app within 48 hours of any change we make automatically, as Google's third-party developer policy requires. You can disconnect the profile at any time from Settings.
Signing quotes electronically
When you send a client a link to accept and sign a quote, and they sign it, we record their drawn signature, typed name, IP address, device/browser information, the time, and a snapshot of exactly what they agreed to, this is what makes the signature legally effective under the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions (Queensland) Act 2001. Quotes at or above $3,300 can't be signed this way, see "Quotes at or above $3,300" below.
Quotes at or above $3,300
Queensland law (the Queensland Building and Construction Commission Act 1991, Schedule 1B) treats a domestic building contract worth $3,300 or more as a "regulated contract" with its own required content, so it can't be signed through WorkPost's online signing page, the client is shown a notice explaining this and offered a PDF copy instead. If your total is $3,300 or more and you do use online signing for a smaller related quote, or the client's copy is delivered another way, Queensland law gives the client 5 business days to change their mind (a "cooling-off period") before you should treat the job as locked in, the app shows a countdown for this and won't move the job to "scheduled" until it's passed. For contracts of $20,000 or more, Queensland law additionally requires you to give the client the QBCC's Consumer Building Guide before they sign, and caps any deposit you take at 5% of the contract price. These are Queensland-specific consumer protections for domestic building work, get your own advice if you're unsure whether a particular job is covered.
Subscriptions and billing
WorkPost Pro is billed monthly or annually (10 months' price for 12 months, billed upfront). There is no setup fee. Pro subscriptions are billed either through the Apple App Store or Google Play if you subscribe in the app, or through Stripe if you subscribe on our website, on the price and billing cadence shown before you pay. Your subscription automatically renews at the end of each billing period (each month, or each year for annual plans) at the same price, on the same date each period, until you cancel, this is disclosed to you before you pay, along with how to cancel. Cancelling: month-to-month means you can cancel at any time, with one tap, in Settings → Billing (if you subscribed via Stripe) or through your app store account (if you subscribed in the app), there's no notice period and no phone call or email required. Cancelling stops future renewals; you keep access for the rest of the period you've already paid for. It doesn't refund the current period unless the app store's own refund policy applies. Deleting your WorkPost account does not cancel the subscription, cancel it separately, wherever you bought it. Nothing in these terms limits your rights under the Australian Consumer Law, including statutory consumer guarantees, which aren't excluded.
Taking card payments on your invoices
If you switch on card payments, you're connecting your own Stripe account and agreeing to Stripe's Connected Account Agreement as well as these terms. The money your clients pay goes straight to your Stripe account, WorkPost never holds it and isn't a party to the sale. You're the one supplying the work, so you're responsible for the job itself, for any refunds or chargebacks, for your own tax and GST on that income, and for the invoice being right. We just create the payment link and record what Stripe tells us was paid. We don't charge a fee on your invoice payments; Stripe charges its own processing fees, which come out of your payout on Stripe's published rates. If a payment doesn't show up against an invoice, check with Stripe first, their record is the authoritative one.
No warranty
WorkPost is provided "as is". We don't guarantee the app will be uninterrupted or error-free, or that AI-generated captions or transcriptions will always be accurate or suitable, you're responsible for reviewing content before it's posted.
Limitation of liability
To the maximum extent permitted by law, WebGecko isn't liable for indirect, incidental or consequential loss arising from your use of the app, including issues with third-party services (Supabase, Groq, Anthropic, Meta, app-store billing) that are outside our control. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that can't lawfully be excluded.
Termination
You can stop using the app and delete your account at any time from Settings, which removes your account and content from our systems. We may suspend or terminate accounts that violate these terms or misuse the service.
Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes will be handled under the courts of that jurisdiction.
